Privacy policy
This policy explains what information Creative DNA uses and why.
Effective 3 September 20261. Who is responsible
Creative DNA by Marbys is operated by Marbys Negretti in Madrid, Spain. Privacy requests can be sent to marktn29@gmail.com.
2. Information we use
We process the account identity supplied through ChatGPT sign in, including your name, email address and account identifier. We also process the ideas, creative profiles, projects, selections, advisory requests and generated material you choose to save. For paid memberships, we keep limited billing records such as plan, subscription status and Stripe customer or subscription identifiers.
3. Why we use it
We use this information to provide and secure your account, generate creative directions, save your work, enforce plan limits, manage subscriptions, answer support requests and meet legal obligations. The main legal bases are performance of our contract, compliance with legal obligations and legitimate interests in operating and protecting the service.
4. Service providers
ChatGPT Sites and OpenAI infrastructure support hosting, identity and creative generation. Stripe processes payments and billing. Creative DNA does not receive or store your complete card details. These providers process information under their own terms and privacy commitments.
5. International processing
Service providers may process information outside the European Economic Area. Where required, transfers must rely on recognised safeguards. ChatGPT Sites does not currently provide a data residency commitment.
6. Retention
Account and project information is kept while needed to provide the service and for a reasonable period afterwards for recovery, security and dispute handling. Billing and transaction records may be retained for the periods required by tax, accounting and fraud prevention law. You may request deletion, subject to those obligations.
7. Your rights
Depending on where you live, you may request access, correction, deletion, restriction, portability or objection. You may also complain to the Spanish Data Protection Agency or your local supervisory authority. Send a request from the email associated with your account so we can verify it safely.
8. Cookies and security
The service may use essential session and security technologies required for sign in and operation. We do not currently use advertising cookies. We apply reasonable safeguards, but no online service can guarantee absolute security.
9. Changes
We may update this policy when the service or legal requirements change. The effective date above identifies the current version.
